anticipates making any changes to the external appearance of his/her house
and/or yard must first obtain approval from the Architectural Control Committee.

I.
Overview/Purpose
The Architectural Control Committee (“ACC”) Design Standards are an official
document developed according to the Declaration Of Covenants, Restrictions, And
Easements For Arranmore Subdivision (“Covenants”), as detailed in Article V.
The Design Standards are intended to enable homeowners to make changes to
their home/lot, while promoting continuity and harmony within the subdivision,
recognizing the importance of maintaining the value of the subdivision as a
whole.
II.
Guidelines
The Design Standards are intended to complement the Covenants, and should not be
considered a replacement. Homeowners
should consult the Covenants, as well as the Design Standards, when
contemplating a change to their lot and/or home exterior.
Such changes are grouped in two categories:
A.
Changes
which require the approval of the ACC

Removing trees or entire
pine islands
¨
Painting exterior of home
(i.e. exterior walls/trim/doors/shutters, decks)
paint palette to select from
¨
Outlining flower beds and
pine islands with trim that can be seen from the street
¨
Grading
¨
Replacing an existing
window or front door
¨
Laying of rocks not
common to area
¨
Painting of any
non-painted surface (i.e. decks, fences, mailbox posts, cement walkways)
¨
Replacing garage doors
¨
Swing sets, trampolines,
tree houses, basketball goals, dog houses, swimming pools Basketball
goals cannot be mounted to house as outlined by Convenants
¨
Adding any structure, as
outlined and defined in Covenants 1.17(a) (other than trees/shrubs)
The standard setback is 10 feet from the
rear and side property lines [Covenants 6.09].
The 10 ft county setback from edge of permanent water/sewer easements
cannot be waived. Additions must be
placed behind the primary structure, unless primary structure is on a corner
lot, in which case it may be no closer to the street than the primary structure.
Maximum square footage of structure: 650 square feet.

Fences
May not be constructed using wire, wire
mesh, or chain link. Finished side must face out (braces/supports must face into
yard). May be constructed on the
property line, so long as a survey is conducted or neighboring property owner(s)
agree to property line. The 10 ft
county setback from edge of permanent water/sewer easements cannot be waived.
Requests should include a drawing/photo of proposed style, including rails and
pickets, and a description and/or sample of the paint/stain to be applied, if
applicable. Height limit 6 feet.

Storage Sheds/Gardening
Sheds
Painted to blend in with surroundings.
Maximum size allowed 10x10. Must
be placed behind the primary structure, unless primary structure is on a corner
lot, in which case
it maybe no closer to the
street than the primary structure.

Modifications to
shutters, doors, roofs, brickwork, driveways, walkways, foundations, steps,
decks, garage doors or house siding
¨
Replacement of mailbox
with anything other than cedar post and black mailbox
¨
Erosion control, with,
but not limited to, timbers
¨
Any excavation, etc.
affecting natural flow of water on lot, as outlined in Covenants 1.17(b).
¨
Any change in the grade
of the lot as outlined in Covenants 1.17(c).
¨
Any addition to main
structure which alters the square footage or appearance of home/lot (including,
but not limited to, enclosed patios/porches, windows, doors, dormers, sky
lights, solar collectors)
¨
Any other changes not
listed in this document which would alter the appearance of the home’s
exterior
B.
Changes which DO NOT require the approval of the ACC
¨
Creating
pine islands/flowerbeds, planting flowers/shrubs/trees/grass, laying pine
straw/mulch (removal of entire beds needs approval)
¨
Installing sprinker
systems
¨
Placing a “For Sale”
sign or security sign less that 18” on your own property
¨
Outlining flower beds and
pine islands with trim not visible from the street
III.
Submission Of Change Request Form
A.
For changes which require the approval of the ACC, a Change Request Form
must be submitted to the ACC, accompanied by:

To-scale site plan
(overhead and side drawings of lot) showing proposed/existing structures,
topography of lot, and areas affected in relation to house/deck,
driveway/street, property lines, and sewer/water easements [Covenants 5.06].

Color samples
¨
Drawing/photograph/brochure
of proposed structures
¨
Written description of
work to be performed, including materials to be used, specified distance of
structures from property lines/easements, size/dimensions of structure, change
of elevation (include plans for grading and water run off), and type/finish of
materials to be used.
¨
If applicable, name and
phone number of contractor, along with blueprints, permits, etc.
¨
Impact on neighboring
properties (access, sunlight, privacy, view, drainage)
B.
The
Change Request Form and supporting documentation must be
submitted to the ACC in writing prior to commencement of work.
Work must not begin until approval has been granted by the ACC.
IV.
Response To Change Request
The
ACC will review all Change Requests and provide a written response in the
homeowner’s mailbox within 30 days of receipt of a complete Change Request
form. If a site visit is necessary
to clarify proposed work, the ACC will set up an appointment with the homeowner
at a mutually convenient time and date within the 30 day review period.
In cases where neighboring properties might be affected by the proposed
changes, those homeowners will be contacted and allowed to voice their opinion
so that a mutually-agreeable decision can be reached.
If
the Change Request IS APPROVED, work
should commence within 90 days and be completed within 1 year [Covenants 5.07].
It is the responsibility of the homeowner to comply with all applicable
federal, state, and local laws, codes, regulations, and requirements in
connection with such work; and obtain any necessary governmental permits and
approvals for such work. The Board
of Directors and Architectural Control Committee have no responsibility with
respect to such compliance and any approval shall not be understood as making
any representation or warranty that the plans, specifications, or work comply
with any law, code, regulation, or governmental requirement.
When finished, the homeowner is required to notify the ACC in
writing. At that time, a site visit
will be scheduled and a Certificate Of Compliance will be issued.
If the Change Request IS NOT APPROVED,
the ACC’s written response will include a statement of the grounds upon which
such action was based [Covenants 5.08(c)] along with recommendations for
resubmission of an acceptable Change Request Form.
If a homeowner is not satisfied with the decision of the ACC, appeals may
be submitted in writing within 10 days to the ACC.
The ACC shall review the homeowner’s appeal and respond in writing
within 30 days [Covenants 5.04(b)(ii)].
If the ACC does not respond to a Change Request in writing within 30
days, the homeowner may proceed with the proposed changes [Covenants 5.09].
V.
Enforcement Of Design Standards
While the ACC encourages
homeowners to work out their differences themselves, complaints of Covenant and
Design Standard violations can be submitted to the ACC in writing.
Enforcement of the Covenants and Design Standards is authorized by the
Covenants and supervised by the Board of Directors [Covenants 5.02, 5.11, 6.14,
8].
VI.
Assistance
From The ACC
Homeowners may submit requests
for design assistance to the ACC. Although
the ACC cannot provide structural engineering support, it can help by
recommending books, training, existing designs, and outside services.
As requested, the ACC will assist homeowners by organizing the bulk
purchase of supplies and/or services, and recommending services (i.e. lawn,
painting, landscaping, woodworking).
VII.
Conclusion
The ACC is always open to suggestions regarding the improvement/modification to
the Design Standards. All
suggestions should be submitted in writing to the ACC Chairman.
Periodically, the ACC will revise the Design Standards, as necessary
[Covenants 5.05].
